NonCriminal Justice Applicant's Privacy Rights
§ 502.19 Primary management official.
Primary Management Official means:
-
Any person having management responsibility for a management contract;
-
Any person who has authority:
-
To hire and fire employees of a gaming operation; or
-
To establish policy for the gaming operation.
-
-
The chief financial officer or a position with duties similar to a chief financial officer.
-
The general manager or a position with duties similar to a general manager.
-
Any other employed management official of the gaming enterprise as documented by the Tribe as a primary management official.
Key Employee means:
-
Any person who performs one or more of the following functions for the gaming operation:
-
Bingo caller;
-
Counting Room Supervisor;
-
Chief of security;
-
Floor manager;
-
Pit boss;
-
Dealer;
-
Croupier;
-
Approver of credit;
-
Custodian of gaming systems as defined in 25 CFR 547.2 and similar class III systems, gaming cash or gaming cash equivalents, gaming supplies or gaming system records;
-
Custodian of surveillance systems or surveillance system records.
-
-
Any gaming operation employee authorized by the gaming operation for unescorted access to secured gaming areas designated as secure gaming areas by the TGRA;
-
If not otherwise licensed as a key employee or primary management official, the four persons most highly compensated by the gaming operation;
-
Any other employee of the gaming enterprise as documented by the tribe as a key employee.
Work Permit Employees:

These employees are required to qualify in a background process from the Tribal Gaming Commission.
Gaming Vendor -
Vendors who manufacture, supply, distribute, provide service or repair to the following products utilized in the conduct of Gaming Activities:

Gaming Devices
-
Electronic Table Games
-
Gaming Tokens
-
Gaming Chips
-
Drop Boxes
-
Cash Handling / Counting Equipment
-
Coinage Handling / Counting Equipment
-
Bill Validators
-
Coin Comparitors
-
Gaming Monitoring Systems
-
Customer Monitoring Systems
-
Surveillance Systems
-
Other Vendors who are a manufacturer, supplier, distributor, provides service or repair of other devices utilized in conjunction with Gaming Activities that have been determined by the Executive Director of the Cherokee Tribal Gaming Commission as warranting a Gaming Vendor classification for purposes of license in the jurisdiction.

Vendors who are parts distributors that only provide repair parts for Gaming Equipment or Cash Handling Equipment SHALL BE classified as either a Minor or Major Vendor depending upon the revenue thresholds contained therein. This exemption from the Gaming Vendor category precludes a parts distributor from selling Gaming Equipment. Should the parts distributor provide new Gaming Equipment or original Cash Handling Equipment then they SHALL apply and be licensed as a Gaming Vendor under these regulations. If not otherwise included, the four most highly compensated persons in any gaming operation; or Any person who is a controlling shareholder of a management contractor; or
-
Any equivalent position in a gaming operation that the Commission designates by its rules as a key employee.
Major Vendor -
Vendors who exceed gross payments from the Casino Enterprise in excess of $500,000.00 (Five-Hundred Thousand Dollars) within a fiscal year OR Vendors that would require access to a Secured Area within the Casino Complex as defined by the Cherokee Tribal Gaming Commission.
Minor Vendor -
Vendors that receive gross payments from the Casino Enterprise in excess of $100,000.00 (One Hundred Thousand Dollars) but NOT more than $500,000.00 (Five-Hundred Thousand Dollars) within a fiscal year OR Vendors that conduct business “on-property”.
Exempt Vendor -
Vendors and the following business “types” that conduct business within the fiscal year that DO NOT receive gross payments from the Casino Enterprise in excess of $100,000.00 (One Hundred Thousand Dollars) AND DO NOT conduct business “on-property”, SHALL BE treated as an Exempt Vendor:

Public Utilities regulated by the Eastern Band of Cherokee Indians or the State of North Carolina
-
Hotels, Motels, or other Lodging Facilities located within the State of North Carolina
-
Professional entertainers, sports figures, and other celebrities engaged by a licensed Gaming Facility to appear at casino-sponsored special entertainment or promotional events
-
Large Retail Chain Stores (Wal-Mart)
-
Medical corporations, partnerships, or sole proprietorships, where the officers, directors, and owners are physicians licensed in North Carolina
-
North Carolina or Federally Certified Educational Institutions
-
Attorneys licensed to practice law by the Eastern Band of Cherokee Indians or the State of North Carolina, including legal partnerships and legal professional corporations
-
Accountants/Auditors licensed to practice by the Eastern Band of Cherokee Indians or the State of North Carolina
-
Major Newsprint Media Purveyors
-
FCC Regulated Broadcast Media Purveyors (Radio / Television)
-
Agencies of Federal, State, or Tribal Government
-
Insurance Companies licensed to transact business by the Eastern Band of Cherokee Indians or the State of North Carolina
-
Any other vendor who has received an approved exemption, in writing, from the Executive Director of the Cherokee Tribal Gaming Commission
